Amputation As A Result of A Catastrophic and Serious Personal Injury

When an individual has been involved in a catastrophic, serious, and traumatic accident, he or she may be left without a body part as a result. An amputation is the removal of a body part. This may occur as the injury itself, or it may occur as a result of the injury.

When the amputation is the injury itself, it means that the victim of the accident had a limb severed in the course of the catastrophic accident. This may happen when an individual is involved in an accident that involves a large structure or sharp object falling on them.

While limbs can be reattached in some cases, many times they receive too much damage and are beyond reattachment. This happens when an individual suffers severe nerve damage, the limb is crushed, or the limb dies because it has been detached for too long. In other cases, individuals may have to have body parts surgically removed as a result of the accidents that they have been in. This occurs when a body part is severely damaged and has no chance of being repaired. Often, these irreparable body parts are dangerous to the individual's heath, which is why they must be removed.

In other cases, they may cause an individual a great deal of pain and suffering if left attached. In either case, victims of amputations, usually referred to as amputees, may be entitled to financial compensation if another person's negligence was the actual and proximate cause of the accident that resulted in the the victim's unnecessary pain and suffering.

California: A State That Has Many Deadly Severe Truck Personal Injury Accidents

Of the 4,749 people killed on California streets and highways in 2008, only 304 died in accidents involving heavy trucks such as tractor-trailers and large trucks called single-unit trucks such as those used to haul soil, road construction debris and other heavy materials. That percentage may seem small compared to the tragedy of nearly 4,800 killed in California that year, but it would be a mistake to dismiss the dangers of these big rigs sharing the road with motorcycles, passenger cars and other small personal vehicles.

Why are California truck accidents so deadly? Several factors combine to make these accidents more likely to result in fatalities than accidents involving other types of vehicles are. The first, and perhaps most important, factor is physics. Trucks weighing tens of thousands of pounds take longer to accelerate to highway speeds and much longer to slow down. Tractor-trailers weigh up to 80,000 pounds when fully (and legally) loaded. If one of these traveling at any speed strikes a vehicle weighing 2,600 pounds, such as a passenger vehicle, you don't have to be a physics student to understand the results will be disastrous for the occupants of the smaller vehicle. To paraphrase Newton's Second Law of Motion, F = ma, or Force = mass times acceleration, any object weighing 50,000 or more pounds traveling at 40 or more miles per hour creates a fearsome amount of force released in all sorts of unpleasant and unpredictable ways when it collides with another object.

The second reason California truck accidents are so deadly is that, for truck drivers and trucking companies, time is money, and the more time they spend on the road, the more money they can make. The law states that truck drivers may not drive more than 11 continuous hours or drive 14 hours after beginning a duty shift without taking at least a 10-hour break. There are other restrictions regarding how many hours they can drive in a week. That sounds reasonable. However, a "restart" provision in trucking laws allows a driver to log up to 77 hours behind the wheel in a 7-day period or 88 hours in 8 days under certain conditions, which isn't reasonable at all. This leads to fatigued drivers, slow reaction times and deadly California truck accidents caused by impaired driver perception and reflexes. These rules are currently under review by the Federal Motor Carrier Safety Administration, and we should expect a ruling by July 2011.

There are many other reasons why California truck accidents are so deadly, such as drivers impaired by drugs or alcohol, talking and texting on cell phones, drivers without proper training and experience, poorly maintained trucks, the sheer volume of traffic on California streets and highways, etc. However, most of these reasons either directly or indirectly lead back to the first and second reasons in one way or another. These vehicles are massive and outweigh everything else on the road. An object traveling at 55 mph travels 81 feet every second. If anything impairs a truck driver's reaction time, even for a fraction of a second, the chances of a deadly California truck accident occurring are much higher.

Severe Auto and Truck Accidents Should Not Be Ignored

Auto and severe Truck accident injuries shouldn't be ignored for a number of reasons. First and foremost, to maximize the chances of complete healing of your injury, you need to tend to it right away. Don't wait. . Your body enters a critical window of time after any injury. The more that you do during this time period to support the healing process, the better off you're going to be. Not attending to your injuries increases the likelihood that you could suffer chronic pain in the future, and you don't want that.

Many auto and truck accident victims are rightfully thankful to be able to walk away from their accident. We thank our lucky stars, etc. Relieved that we are still alive, that we don't have any fractures or cuts, that we are able to walk, we assume that we've survived the accident and are going to be fine. Fortunately, in most cases this is true.

Many car and truck crash victims develop acute symptoms afterward. Acute refers to severe pain and swelling. Naturally this varies depending on the accident. But it is surprising how low end collisions with little or no damage to the car can (and do) cause injuries. Truck related injuries are always more serious and life threatening. The most common complaints after a car and severe truck collision accident are:

* Neck pain
* Neck stiffness
* Headache in the back of the head
* Back pain
* Numbness or tingling in the arms, hands


It is important to document any possible injury as soon as possible after an auto accident. This is true for legal reasons in addition to the fact that you want to heal your injury as quickly as possible. If you wait a week, two weeks or a month it looks like it's no big deal. And this is not the message that you want to send to your insurance company. It is in your best interest to have any injury documented as quickly as possible. Having said that, if you've waited a week, two weeks, a month or several months, and are still suffering from complaints related to your accident, still see a doctor to have them evaluated. Going late is better than never.
